CircleCityAuctions.com User Agreement
The following User Agreement (the "User Agreement") contains the terms and conditions for the use of our auction system. By submitting your registration, you agree to the terms and conditions contained below in this User Agreement.
The User Agreement may be periodically updated by CircleCityAuctions.com at any time. The amended User Agreement will be posted on the site and must be accepted by any and all participants of the system and its services. Acceptance of the User Agreement requires you to abide by the Guidelines (the "Guidelines"), which explain the site rules, as well as acceptable and unacceptable conduct by users. If you do not accept the User Agreement, you are prohibited from using the CircleCityAuctions.com
site services.
Eligibility & Registration
The use of the CirlceCityAuctions.com auction system and services is limited to parties who can enter into and form legally binding contracts under applicable law. Minors (those under 18) are prohibited from using the system and services. Users must provide truthful and accurate information when registering, as registration indicates acceptance of this User Agreement. CircleCityAuctions.com reserves the right to refuse use of the system and services to anyone at any time for any reason without notice.
Use of the Services and Site
Use of the services of the CircleCityAuctions.com website is governed by this User Agreement and the appropriate site Guidelines. CircleCityAuctions.com commonly permits use of this site's services by registered users.
Prohibited Use: Any data or e-mail mining, any other use of user information not associated with this agreement or the Guidelines is strictly prohibited. Misleading or fraudulent registration, listing or buying activities is strictly prohibited. Spam, unwanted, or obtrusive attempts to solicit users is strictly prohibited.
Termination: CircleCityAuctions.com reserves the right to refuse use of the system and services to anyone at any time for any reason without notice or explanation
Listing & Selling
Registered users can post items for sale in fixed, dutch or reserved auctions. Sellers are obligated to provide as accurate & detailed information as reasonably expected for items posted for sale. Items should be posted in appropriate category, include detailed descriptions including status and condition of item, pictures if available, item location, accurate and reaonable shipping and handling costs etc. Sellers agree to adhere to the standards and guidelines of circlecityauctions.com related to terms and should take efforts to protect the privacy of information collected from users of winning bids.
Sellers should complete auction transactions with winning bidders within reasonable time period and assurance to deliver item in manner described. Sellers should make reasonable effort to communicate with winning bidder within 7 days of auction conclusion to arrange payment and shipping.
Listing Manipulation: Listing manipulation in any form, and for any reason is strictly prohibited!
Bidding & Buying
Bidders must honor all successful bids placed in any auction, and are obligated to complete the transaction with CircleCityAuctions.com or the respective seller. The winning bid is defined as the high bid in a regular auction (one with no reserve price) or the high bid in a reserve auction that meets or exceeds the reserve price. By bidding in the auction the Buyer agrees to honor all listed terms of sale including, but not limited to, method of payment, appropriate state sales tax, and shipping and handling fees. Failure to honor this obligation may result in the termination of the Buyer's registration.
Bid Retraction: Bids are not retractable except under circumstances deemed appropriate by CircleCityAuctions.com. Possible examples include instances when a seller makes material changes to the description of an item, or when blatant typographical errors are present.
Buyers should make reasonable effort to communicate with seller within 7 days of auction conclusion to arrange payment and shipping.
Bid Manipulation: Bid manipulation in any form, and for any reason is strictly prohibited!
System Integrity
Undermining the usability or working condition of any CircleCityAuctions.com site or web server is strictly prohibited. Unauthorized use of passwords or user accounts is also prohibited. Do not share your account information with other parties.
Breach of the User Agreement
Breach of this User Agreement may result in termination or temporary suspension of your CircleCityAuctions.com account. Providing inaccurate registration information constitutes breach of this agreement.
No Warranties
The CircleCityAuctions.com website is provided "as is". CircleCityAuctions.com makes no warranties or representations of any kind, expressed or implied. CircleCityAuctions.com does not guarantee the availability of any of its services.
Limitation of Liability
CircleCityAuctions LLC, LLC II, it’s employees, owners, partners and affiliates shall in no event be held liable for any damages arising out of use (or inability to use) of the site and services, or in connection with this User Agreement. Acceptance of this User Agreement and participation in our services requires the user to hold Circle City Auctions LLC, LLC II harmless for any actions or consequences related to your participation in this site your acceptance to and agreement to abide by our Legal Disclaimer.

Acceptance of this User Agreement and participation in our services requires your acceptance to our Privacy Policy.
General Release
Buyers and Sellers agree to release CircleCityAuctions.com and its employees and agents should a dispute arise between the parties during a transaction. Each party agrees to release CircleCityAuctions.com from claims, demands, damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way associated with such disputes.
Legal Compliance
Users are required to comply with all local, state and federal laws regarding use of our services.
